Case Study 7

Estate, Will, and
Trust Changes

Tom represented a Trustee in a Trust dispute. The main item of dispute was a memorandum signed by the Decedent, giving certain original paintings to Tom’s Client, serving as both Trustee and Beneficiary. A petition was brought by the Trustee’s sibling claiming that the memorandum was forged and invalid, that the real property appraisal that the Trustee obtained from a Licensed Real Estate Appraiser undervalued Trust property, and that the Trustee/Beneficiary received loans of $250,000 from the Decedent in the decades prior to the Decedent passing.

After almost 2 years of litigation - by addressing the claims with methodical and steadfast gathering of evidence to the contrary - the claim of the sibling for $500,000 was eventually settled for the sum of  $18,000.
